Terms of Use

1. The agreement

These terms apply to the Train of Thought app for iPhone and iPad (the “app”), made by David Noé Bänziger (“we”, “us”). By downloading or using the app, you agree to them.

The app is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add what’s specific to Train of Thought. Where they conflict with the Standard EULA, the Standard EULA applies. Our Privacy Policy explains how the app handles data.

2. What the app is, and isn’t

Train of Thought is a focus timer that shows your session as a simulated train journey. It is not a travel planner, a timetable or a ticketing service, and the tickets it prints aren’t valid for travel.

Routes, running times, speeds, stations and trains are based on open data and our own models. They’re meant to feel real, but they can be incomplete or wrong, so please don’t rely on them to plan actual trips. The app isn’t a medical product and makes no promise about your productivity or health.

3. Using the app

• You may use the app for your own, non-commercial purposes on Apple devices you own or control, as the Standard EULA allows.
• Don’t use the app when it could distract you from something that needs your full attention, such as driving.
• Some features need an internet connection, and your mobile provider may charge for data. Downloading maps before a ride uses data once, up front.
• Don’t try to reverse engineer the app, get around its purchase checks, or use it, or the map and routing services it relies on, in a way that’s unlawful or overloads them.

4. Free features, Pro and purchases

The app’s core, planning a journey, riding it and keeping your logbook, is free with no time limit. Optional purchases are sold through the App Store:

• Train of Thought Pro, monthly or yearly: an auto-renewable subscription that unlocks the Pro features described in the app.
• Train of Thought Pro, lifetime: a one-time purchase of the same features. It never renews.
• Individual trains: one-time purchases that unlock a single train.

Payment and renewal

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for the renewal within the 24 hours before the current period ends.
• Prices are shown in the app before you buy, in your local currency and including any applicable taxes. If a subscription price goes up, Apple tells you in advance and, where required, asks for your consent.

Free trials

If a plan includes a free trial, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. The app reminds you before a trial ends if you allow notifications. Any unused part of a free trial ends when you buy a subscription.

Managing, cancelling and refunds

• Manage or cancel a subscription in your device’s Settings: tap your name, then Subscriptions. The app’s own settings link there too.
• When you cancel, you keep Pro until the end of the period you’ve paid for.
• Apple is the seller of record, so refunds are handled by Apple under its policies at reportaproblem.apple.com. Your statutory rights as a consumer, including any right of withdrawal, apply through Apple.
• To restore purchases on a new or reset device, use Restore purchases in the app’s settings while signed in with the same Apple Account.
• Purchases aren’t available through Family Sharing.

5. Changes to the app

We keep improving Train of Thought, so features may be added, changed or retired over time. If a change takes away a significant part of what a paid subscription includes, we’ll say so in the app, and you can cancel before the next renewal.

6. Your content

Names, notes and purposes you enter are yours. They stay on your device and, if you use sync, in your own iCloud. We don’t receive them, so we claim no rights to them. Keep your own backups: sync and Export logbook are there for that.

7. Third-party data and services

• Map data © OpenStreetMap contributors, available under the Open Database Licence. Map design and tiles © Mapbox.
• Routes are found with OpenRailRouting, and station search uses Photon by komoot.
• Soundscapes are mixed from field recordings shared on Freesound under CC0 and CC BY licences, credited in the app.
• Trains in the app are modelled on real rolling stock. Their names are used only to describe them; they’re trademarks of their owners, and no railway operator or manufacturer is affiliated with or endorses Train of Thought.

These services are provided by others and may change or be unavailable at times, which can affect planning new journeys. Their own terms apply to them.

8. Our rights

The app, including its design, code, train models, artwork and sound mixes, is protected by copyright and other laws, and belongs to us or our licensors. The Standard EULA sets out what you may and may not do with it.

9. No guarantees

We work hard to make Train of Thought reliable, but to the extent the law allows, the app is provided “as is”, without any promise that it will always be available, error-free or suited to a particular purpose. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live.

10. Liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, for lost data, or for more than the amount you paid for the app and in-app purchases in the twelve months before the claim. None of this limits liability for intent or gross negligence, for injury to life, body or health, or anywhere else the law doesn’t allow liability to be limited.

11. Ending these terms

You can stop using Train of Thought at any time by deleting it; cancel any subscription separately, as described in section 4. If you break these terms or the Standard EULA, your right to use the app ends automatically.

12. Changes to these terms

We may update these terms, for example when the app changes or the law requires it. The effective date above always shows the current version, and we’ll point out significant changes in the app or on this page before they apply. If you keep using the app after that, the updated terms apply.

13. Governing law

These terms are governed by the law of Switzerland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you use the app as a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim before the courts there.
